hi,

i just posted a thread askign for one thing and was shocked with another.

Can anyone please verify with me wether or not it is illegal to run an adult website even if it is not hosted in australia ?

If you think or know that it is, do you know of any links or webpages that clearly state all these ederal rules and regulations ?

im jist a bit worried now, as i cash all my cheques into my bank a/c , and was alos thinking of registering a proper business name to claim some ta write offs.

Chill the laws you would of heard about where brought in to action 01/01/00 they did not have any major effects last new year was a bit of a worry (I personally had my bags packed) It would (may) only cause you a problem if you decide to host your sites in Aus even then it can be done.The major problem was they was going to block porn but it turned out to be just a political game, I am more worried about the USA system then the Australian law/political system.

Being a POM in Australia I think the British system is a lot more of a worry I have heard of webmasters taken to court for uploading pornographic material on the phone lines (not 100% sure how true that is)

Juggler, its all true.

Uploading (via ftp say) is deemed to be "publication" of porn.

The problem is whether or not the porn is considered to be "obscene".

I've read the obscenity act, its fucking so outdated. (50s or 60s i think)

Obscene is defined as something that might "corrupt" if i remember rightly. WHAT THE FUCK!

What was considered obscene then, and now, is two different things.

So juggler,

do you run a legitimate business, in the sense that you have registered a business name and claim on tax that you arean adult webmaster in australia ?


Because, if you do that, then everything is ok, but if i as an aussie citizen cant claim that on my tax form or cant claim what i do as a legal business, then it's not really legal in the first place.

I know that you can get away with making tons of porn sites, and simply funnell the money into international accnts where they cant be touched, but this is not the case for me, as i want to register a business name and make my venture a legitimate business.

I'd rather pay tax to my own country than be helping out some little dot on a map jiust because they dotn have any taxes there.

hey - i don't think that danger dave posts any hardcore at all, does he? maybe you could ask him about what laws to check out.

i'm not in australia, but i have also heard that doing porn is illegal there - but that's only what i've heard...

Sorry you may have got me wrong I was saying chill to porn being legal in Oz not to the tax, I had not read the other post when I wrote that I will be VERY interested to hear where Noddle gets his info from on that matter.

As far as Tax yes I have paid and will pay in the future I am not currently a registered business my tax in the past was taken as income and added to the income I received under a business I was running (entertainer/trainer) it worked out better that way. I will be registering as a business early next until then I will be trading under my own name, either way your income is taxable and classed as earning and of course you can claim any expenses you incur running your Biz. You need to talk to an accountant about this, anyone who knows of a good one in Melbourne please let me know as the one I had was fine for what I use to do but hopeless for a web based Biz.

But as far as the legal issues I would like Noddle to tell us where this Info of his comes from. The bill that was passed last year was a political joke and it was just to gain a vote (which they did not get) and it was never aimed at outlawing Internet porn but blocking access it by means of blocking software being forced to be used by ISP, this turned out to be nothing more than a political pissing match.

Noddle gives the Bill names dates of issue etc of this bills that you know of
