You cant say "i thought they were in the piblic domain... email me and i will take them down".
To compare this: Its like stealling something, and waiting to get caught. When you do, you take the goods back to the shop, and everything is ok...
If i were a content provider, i would kick some ass over this. But then agian, i am not http://adultwebmasterinfo.com/ubb/smile.gif

Dude, there are lot of sponsors who give you content to help promote their programs. I't very common practice these day. And hell, you can download photo-sets from Web-Legal for like $25 or $50.

Then I guess Britney Spears could sue every persons who has a web site with *FALSE* picture of her for diffamation and stuff like that.
Even if you say it's her! Yeah right! It's worst if she nude and it's not fake. I guess she would never agree to have her nude pics on the net. She's too sweet for that. http://adultwebmasterinfo.com/ubb/smile.gif

sqnet,
Yeah I know I am a newcomer to this particular board, but I have to say, in the 4-5 years I have been doing this, I find this board has the highest entertainment value of any I have had the pleasure of stalking in, and Sqnet, it is people like you that give me the greatest amusement. The fact that you are so blatant with your ignorance that someone has the gall to say "You cant say 'i thought they were in the piblic domain... email me and i will take them down'" is hilarious. It leads one to believe that there is such a thing. Guess what? There isn't.
Free advertising . . . man you crack me up, you should give up this stuff and get into stand-up comedy or something, maybe as a writer for some dumb-shit sitcom. Mr Brian is a very nice guy indeed, I'd have your head on a pike for all to see what happens to thieves if it were I you did this to.
But you are good for a laugh anyways, thanks.

Rich,
No, unless you are talking about football teams, there is no such thing a public domain when it comes to photographs. Copyright does not have to be applied for.
To get copyright protection, a work must be the result of at least some creative effort on the part of its author, and the work must be original--that is, independently created by the author. It doesn't matter if an author's creation is similar to existing works, or even if it is arguably lacking in quality, ingenuity or aesthetic merit. So long as the author toils without copying from someone else, the results are protected by copyright.
So unless you took the picture, someone else has the copyright on it. There is no public domain when it comes to pics, no matter if you get them off a news group or not, and oh yeah, ignorance of the law is no excuse.

I mean its almost impossible to know they owned them!

According to what I've learned today, you should buy the pictures from someone who's willing to sell them to you... and there's some place where you can buy them at 25$/100$... http://adultwebmasterinfo.com/ubb/smile.gif

Linux isn't "public domain", it's released under the terms of the GNU General Public License.

ok, I am taking this direct from a free host F.A.Q. and yes, technically this is a copyright violation:
Do not post copyrighted material that does not belong to you. There isn’t any such thing as “public domain”. Someone took the picture, someone owns the picture! Don’t go browsing news groups finding pics that you think are “public domain” and then post them on your web site because most likely they are owned by Hustler, Penthouse or Playboy and your site will get deleted!
This is a pet peeve of mine which is why I use whatever opportunity I find to educate the masses to this issue. While you might get away with it for a while, don't think for a second that they don't actively pursue violators. Especially if you become successful, more traffic means more exposure and hence greater opportunity to get caught and sued.
Ends my law lesson for the day. Education beats prosecution every time in my book.

Sorry forgot to address your question. Yes they can. While you may not know that THEY owned the pics, you do know that YOU do not. In a nutshell, unless you took the pix and got a signed models release (you can't go to the beach and click away then post the pics without one) you can't use the pics for anything other than your own private viewing pleasure. Of course if the person who does own the pics "legally" sells you or grants you license to use them then you have whatever rights are conditioned under the terms of the license.

Ups!
A little out of topic, but bad_dogs last post made me thinking...
I was planning to attend the Berlin Love Parade 2k. The idea was to shoot some flasher and upskirt pics there. (girls getting really nasty there)
I wanted to use them on my paysite and evtentually sell them over web-legal or other content provider.
Can`t I use the pics that way?
Any help apreciated!

I am talking about pics like this http://www.bz-berlin.de/bz/musik/love/alben/love134.htm
this one was made by a fotografer who sold it to a newspaper to publish it (license).
Anyone knows if I would be able to sell licenses for these pics with an adult content provider?

Nevermind, I buried the idea already.
Got email from Dave at http://www.web-legal.com
Heylo!
That's an easy one. No. No. No. Oh, and No... (smile!) Without
the necessary 18 USC 2257 paperwork on hand, selling that
content is an instant felony, and that's not something that I'm going
to do.
Please let me know if you have any other questions or comments.
Thanks!

Dan, as I said, unless you get these little trollops and sluts to sign a model's release, and give you a copy of identification proving 18 or older, you can't do more than put them in a nice photo album and show them to friends when they come over.
I think you do a great disservice by not directing viewers to http://www.bz-berlin.de/bz/musik/love/alben/love133.htm and http://www.bz-berlin.de/bz/musik/love/alben/love135.htm by the way
