I'm addresing all wemasters who where in working relathionhips with snows vipdialer and got his checks that returned.
As you all know, snow/vipdialer sent us checks that returned and he or some one else owe us lots of money.
I've been thinking of, may be , gathering all of us (who has reseve a checks and they returned)together, and filing a legal step against snow.We have checks, and can show them in court !!! That way may solve not all, but a part of our problems with vipdialer/snow.
I need your help ,spatially US webmasters, with legal knowledge that can advise us.
I think we have a chance to prevent other "sponsors" to take such acts !

If you win in the court, what good will it do to you? You think someone magically Snow will come up with few thousands dollars? If he doesn't have it now, he isn't gonna have it after the court. So what good would it do to you?

If you win a lawsuit that means nothing, you must sue again to get paid.. so you would have to win two lawsuits. Then on top of that all the company would have to do is claim bankrupcy and you get nothing.

Now your collection agencies you refer to pay you $.10 on the dollar. If you could even find one that would take it. I guarantee your court costs would outweight any dime you get.

I think tanin got a point. If sponsors get away with cheating we will see more and more cheating sponsors in the future, and I think we got more than enough already. My advice is to do something to make the life hard for cheating sponsors or shut up. I am getting tired of all you chicken shit webmasters complaining over lost money and no guts to do anything about it.

Tanin I just rated you 5 stars :D

This step will show to all sponsors that we have a power, and not just talking about how we was fucked !

Well, in the US when you have a bounced check, you turn them over to their local District Attorneys office. The more there is the more serious they get.

dont know what collection agency you use but our one pays us from 70-80% of the total amount but hey when it comes down to it who cares who gets the money as long as the company in concern has to pay up :)

You don't need a collection agency. The District Attorneys office will collect for you. They treat bounced checks as a criminal offense, especially if the amount is over $50, and/or there are multiple bounced checks. If the checking account was actually closed then it is a felony even.

Give us more details on the District Attorneys (DA) stuff!

I have quite a few of NSF checks from various sponsors collecting dusts and I want to know where can I send them? Does the DA must be from where the sponsor's bank is or the sponsor's main office ...

All the NSF checks I dealt with were local people, local banks, local District Attorneys office.

I would start the sponsors district attorney for the county that they do business in. (Just call any number in the city they live in and ask them what county they are in)

Call their district attorneys office and without going into too much detail, just tell them you are out of state and have been issued a check for non sufficient funds by a business in their jurisdiction and ask them what the procedures are for you to turn it over to them for prosecution. Some may require it be a certain amount or that you tried to collect the check via certified mail first. It's not difficult at all and while they sometimes take a while getting around to it, they WILL get around to it. Especially if it's a large amount or they have a pile of them from the same person. I've seen people get jailed for it.

Another thing you can do is talk to your bank in advance and call the sponsors bank every day and tell them you would like to do a merchant check on an account, give them the amount of the check and they will tell you whether it will clear or not. I always went straight to their bank and got a cashiers check, but your local bank may be able to process quicker if they know what the situation is.

Good luck,
RD

Maybe I should get into the adult collection business ;)

If you guys need a PI i have a company i used to work for who is owned and operated by a few law enforcment folks and they can get results..

Just let me know if you need to track down the guilty parties or any case related research i got plenty of connections in the investigations field. If you guys decide a class action suite a PI is the best way to go because state dont always have as much time to dedicate to a single case like this and can take ages to obtain the needed evidence.

You allow these guys to buy time and they might skip town. As for what they are doing i can tell you this a company i worked for had $45k siezed by their bank for playing with rubber checks. That was the fine to cover all the bank fees interest and moneys owed to check cashing stores..

Matter fact you can check out their website. http://www.ffps.com

bouncing checks is a serious crime,,,
can cause you to do some serious time,,,
something like 5-10 years,,

i think you should first talk to your bank to see if they can resolve it with the vip's bank
