A #1 Website is using my content inside the members area and
on the homepage and tours, with no permission what so ever.
No model releases. It a #1 porn star too. What is my best way to
make the most amount of money out of this ?
How much money could i look for?

Thanks all again for the suggestions.

IMO if you were being honest you would expose the site.

What if he does and the site takes off all the content that is Softcores? I see your point tho. I would love to know. But I am sure that if he does say something the site would change and change fast!

how do you know its your content ? it could just be a really good copy. have you asked the person to remove it ? maybe you dont have to sue. maybe just a few threats and the money will flow. yeah never know.

Make a screen capture of the site and get others too aswell. Of course they will take it down, but they will do just the same when they here from his lawyers.. wont they? Isnt it better getting the proof now?

have two of us working now taking screen shots and who's is -ing, the photo's are on the affiliate program site, on the buy one get them all site there too, were trying to see who's who and get as much good info as we can. Then on Monday call the lawyers and start the clock rolling with the info..

sorry the photo's are ours we took them, we have the 35mm chromes, the model releases,
we published them in magazines, I know the porn star I shoot her more then once, I know my photo's and there selling the site's from the home page on to the tour with her and in the members area, I don’t know if you have taking photo's before but. I’ve looked at them at least 100+ time each you know them, the makeup artists work!!! the back drop!!! the clothing of the sets!!!, you know you work.... it is not a copy!!!

thanks all

If you dont want to even talk about who it is then why come here to begin with?

You claim that you shoot pornstar content and yet you need the advice of people on a BBS..

I can tell you if your content was so great you should really hire a good lawyer who can advise you on what to do. Coming here and asking for free legal advice on this subject matter is lame. If you come here to expose a crook well then thats another story but this is not the law offices of AWI and no one here can send the C&D for you.

I think it's good not to say who it is before a lawyer has been contacted. However it would be nice to get that info once damning evidence has been secured.

I got a question, don't you have to BUY a COPYWRIGHT for anything you don't want people to pirate? Say if I wrote a book and its on paper, but someone stole it, and reproduced it, and I haven't bought a copywrite for it, They can't sue me because I don't have a copywrite.. So I think you gotta register it with someone before you could sue anybody..

You don't need to buy or have a written copyright. You just need to be able to proove that it's your work. However it's easier to sue if a copyright/ trademark is in question (and you can get some more bucks out of it).

Not in such a case where you have the original works like negatives then its very easy to prove who shot and owns the photos.

Make double sure it's your content, unless you shot it you do not know the history. If it's a porn star it may have come from another source. If it was shot or bought under an exclusive deal your beef is with someone else. If it's a top website chances are thay paid for it.

Yes get as many screen captures as possible and also make sure you can identify the day and time you took them. A video of the screen with the daily paper is good.

When you have all the facts go to a lawyer who understands copyright issues.

And then join APIC and put that up on your website, it deters a lot of thieves who know what they will get if found out.
