Question about my rights with a web host

Hi,
I have got my account suspended without notice for my webhost. they shutted down the site and block all ftp access. They said I took too much resources but didnt tell me how much.
now I want to move my files to a new server, but they're not replying to any of my emails to provide me access to my files.
Do I have a right to my files? can I take some sort of legal action to make them give me access to my files?
can they delete my files without authorization from me?

why would a normal host do such a thing?
they have a potential to make more money.

i was with the power plan, 1200mb of space, 30 gig of bandwith for $30 a month
they allow adult content, they dont seem like one. but read their tos
I though 30 gig was enough for me because I was just starting out, their stat wasnt real time only updated once a month, so I couldnt tell that was juicing up bandwith..
