Hello!<br /><br />Thanks for reading this topic. <img border="0" title="" alt="[Smile]" src="smile.gif" /> <br /><br />Here is the one situation and I'd like to know opinion on this from the any webmaster who has something to say about it.<br /><br />As you know a lot of companies do not allow webmasters from some countries (usually that's <br />ex-USSR, Yugoslavia and some other countries...).<br /><br />I understand this and admit the right of those companies to deny webmasters from some countries to join their programs. That's up to them, and there are some reasons for them to do so (like very high fraud, etc). I do not find this as racism or anything like that. That's ok for me.<br /><br />But here is the different situation. We are american company, but some of the guys who work in our company are russians. We register an account in some program (of course we fill in information of our American company, because we work as an American company), but later they find out that some guys who work with us are russians (that wasn't secret though... who cares if there are few russian guys, if it's american company?) and they ask us to remove their links and tell us that they are not going to work with us.<br /><br />As I see we didn't break any terms. They don't accept webmasters from Russia - ok, we are NOT webmasters from Russia, we are american company and we didn't cheat them in any way.<br /><br />Do they have a right to close our account, don't pay our money and through us out of their program?<br /><br />As I understand this situation - they shouldn't do it. That's wrong. And this situation is sounds a little like racism (I hate this word, though).<br /><br />What do you think? Tell me your opinion please.<br /><br />Thank you.<br /><br />P.S. This topic doesn't have any offence... And I do not name the program which I am talking about, because all I want for now - to know opinion of webmasters.

Have you wrote to them & told them exactly what you have said here? That is the only suggestion I have if you haven't wrote to the company.Maybe a phone call to them might get more results if letters failed you.
it sounds like Your webmaster somehow broke their rules, or how they noticed him ?

Well, they asked to fax them some proves of us being american company. We'll fax it tomorrow. <img border="0" title="" alt="[Smile]" src="smile.gif" /> <br /><br />I don't see big problem here, that's just doesn't smell really well.<br /><br />And that's interesting for me what you people think about it.<br /><br />I won't the name company which are we talking about.<br /><br />Just wondering on opinions of webmasters.

Well if they are working on the web they are webmasters and living in russia they are russian. Sounds to me like your contracting out to russian webmasters in turn bypassing the rules of these programs. <br /><br />In my view it would be the same either way unless those webmasters lived in the US where your company is located. So technically yes they do have a legal standing but i cant say if it would hold up in court im not a lawyer.

Hmmm… tough situation any way you look at it.<br /><br />They reserve the right to deal with whomever they decide to deal with.<br /><br />If a contract is in effect, with clauses covering a situation such as this, the termination of your current arrangement would and should be obvious and may either be absolute or contestable.<br /><br />If no contract exists, your association is based on both parties’ discretion, which gives you very little to work with.<br /><br />My advice, talk to them in a calm and controlled manner stating the facts as you can prove them, and ask for them to reinstate your agreement. First,<br /><br />It's the first time i hear a company asking for proofs that you're citizen of a country...<br /><br />2nd, There is no reason why they shouldn't pay, because the check is send in the USA, right?<br /><br />3rd, What i dont understand is how this happened?<br />there is something missing somewhere in that story.. You apply for a program, you're accepted, you make money, and now it's time to be paid, and theu say, sorry Boris but you're Russian? Come on...<br /><br />4th, I don't agree with that, that they refuse to pay the guy.<br /><br />It was opinion based on what you told us.<br /><br />Like someone said here, I would give them a call.<br /><br />See ya

you say that the program does not allow WEBMASTERS FROM RUSSIA. it says nothing about where the company is based. it appears from what you say that part of your program includes WEBMASTERS FROM RUSSIA.<br /><br />you knew that was against the terms when you joined, right?

Goldie, as it’s an American company that there’s no room for discussion: they will pay you what they owe you and if they don’t, you’ll beat them at any court. It even doesn’t matter if you’re running your company from Moscow or New York – you’re putting your tax money into budget of USA and you have all obligations and right just like any other US company. <br /><br />And why to fax them any proofs when you’ve filled out the sign-up form using the company’s address? You couldn’t cash the checks if you were lying. They’re just finding excuses to keep your money, they suck big time.

Ok here is the deal, and this is what will save you or not. If in fact you are a US company, you must have supplied them with either a social security number, or a federal tax ID. If you did in fact supply this, and it is valid, then you are indeed a US company, and you can sue them for the money they owe you. Period.<br /><br />It does not matter who you have as employees'<br /><br />If this is a large amount of money, over $5,000 then you will need to contact a lawyer, if it is under $5,000 you can file a small claims suit against them.
