Hotlinking is a common thing ammoung webmasters and its pretty shitty but thats why you host on your own hosting so you can block such methods.

we have the permission from the company to use their dialers and the public has the opportunity to read how the dialer works and how much it charges

but in your case, you do NOT have the permission to use those account for adult material (let alone mpgs)

You should talk to some of the people over at GIB and TelcoWeb. They're millions of minutes per month may disagree with your beliefs of how "unsuccessful" dialers are. Oh and let's not forget AT&T which makes god knows how many billions depending on the porn industry. I'm sure if it was deceptive the FCC would object, but they're been around for a long time and will likely stay.

I'm not endorsing dialers, I personally hate them, but they are big business and are around to stay...

I personally prefer using a team of lawyers. They get the job done and that person will never in hell think of messing with you again. You hack his site, big deal... he could technically go after you for damages and such... Not to get personal, but hacking someone's site seems like a childish way to get back at someone. Sorry, I misread your message then. But if someone downloads the dialer, before it actually dials it does display that this is a long distance premium rate call and the rate is usually specified (I never used one, so I'm not positive!). That's enough for me to be a cautious buyer. Same thing as the hooker example above somewhere, hooker tells you its gonna cost $100, some guys could care less and just want to get it over with. If your done in 10 seconds, that's $10/second. Point is, the price is known and specified up front, so whether its a strip club, a member site, a hooker or a dialer, you know the price ahead of time.

I'm curious, Tripod let's you get away with not only porn on their servers, but 20,000 downloads per day at 5 meg a pop? Seems illogical they would keep your account open for more than an hour at those rates. That's 100 gigs of traffic a day which works out to $200-250 in hosting fees on most providers. If I were Tripod, I would send you the bill to be honest.

Actually that hapened to my brother as well and ccbill wouldn't remove the charges so I agree that is fucked up...but on dialers we do NOT advertise them as free...

Well oviously you don't know the second the dialer companys who this person is using sees this...The accounts will be terminated without any thought...

No dialer network allows you to advertise free legally as its illegal and also threatens dialers.

I was speaking to the dialer community as its a big issue when a site such as picpost.com is advertising it because picpost.com can and does reach a large audience...

Dialers are not made to be promoted as free...Just like cars are not made to be driven on the wrong side of the road...You have people who do it but they get their license to drive taken away just as the webmasters get their dialer taken away...

Wow, considering your costing them over $200/day, this hardly covers it. I'd be really careful from their legal team since your putting yourself in hotwater violating Tripod's terms. I assume it's an invisible file, because if you "never ever hotlinked anyone" as you stated, then it would be in that folder with the movie.

So please post the URL that calls that movie.
Unless it's also on tripod, I suggest you never ever accuse someone else of hotlinking you, when you are in fact hotlinking tripod.

You should never hotlink period. Payhost, freehost, they all pay for pipe and your just increasing their cost. Sure, what you did is wrong and what the other guy did is probably more wrong (illegal distribution) on top of hotlinking. But both of you basically are making Tripod pick up the tab for your surfers entertainment. If you guys profit from it (ie: get a signup or a dialer download) then your in a bad position to be sued by Tripod.
