I received a letter from a lawyer about fake jenifer aniston pictures... I have a few quesitons to ask to someone who knows the law real good or a lawyer.
if you can help me please contact me, I can send the 6 pages letter to you so you know what they are talking about and if they have the right to do what they say.

as long is the pics taken down this should be the end of the story. They normally won't pursue unless they sure the webmaster is a rich boy. If any questions, just explain them it was a reseller in your 'webmaster programme' who posted those pics and you weren't aware of that nor responsible but a an honest citizen you took care of it. LOL

basically folks some attorney is trying to scare jimbo only becuase his servers are in the US and they can do shit about that.

He is a canadian. He does not have to comply with US set laws. That woul be like saying hey there Mr. Yankee. Because you drank beer in the park you are subkect to canadian laws about public intoxication. Like your gonna follow it???

Pooky, you say you specialize in american and australian law, and make comments like that? I am sorry, but you are so full of shit. I have not read the letters in question, but let me assure you that no fucking International border is going to prevent a lawsuit, the only question will be the venue, or in other words which state/providence/country has jurisdiction for the trial.
I know Jimbo has been doing celeb for as long as I have known who he is, and it can be hard to teach old dogs new tricks, but all celeb sites run an inherent danger of attack by the celebs whose pics are said to be contained within them.
Ever hear of copyright laws, license to use, etc? I highly doubt Jimbo has either the copyright or the license to use the pics on question, whether fake pics or not, or else he would not be getting letters from attorneys representing the celeb. If he did it would be quite simple to tell the attorney to go fuck himself. Instead the attorney can easily to Jimbo that he is the one that will get fucked.
Fake celeb pics should be looked at the same as if you were selling sugar-cubes for $4.00 each stating they were laced with LSD, when in fact they were not. You might as well be selling the LSD laced ones in the eyes of the law, the penalty would be the same.
Jimbo, I am a California paralegal in addition to anything else I may do, and if you wish I will give you a more accurate appraisal of the situation if you desire, but it sounds like you have done the right thing. However, you should be prepared to receive future correspondence as this attorney, if smart will be contacting other celebs and saying, hey, guess where I found unauthorized pics of you.
I would not pay too much attention to playa's assertion that "most celebs don't mind since its like free press for them." That has to be one of the most inane comments I have read in a while, and would have to guess that playa must be quite young to make a comment like that. That is one thing I have always liked about this board, it never fails to provide me with a laugh, some of you really do crack me up.
One thing, you may run across a border to change servers in an attempt to hide from pending lawsuits, but I would think that most owners of servers that have a clue, or that are doing a successful business, have access to attorneys, and will follow their advice and shut your site down rather than go into court with you, and it will make it a little tough to make any money while your site sits in DNS limbo.

I also received a letter. I don't think they will do something about it if you will remove the images. Most of the celebs don't care, as it's free press for them. Don't be scared dude, it's just a warning, and just follow the 7 rules they wrote, everything will be fine then :-)

bad_dog, the crime in selling lsd is in the actual possession and/or sale of the lsd.
you may be guilty of some small crime if you are selling the sugarcubes, but i knew several rip offs that got busted and when it turned out the drugs they were selling were not drugs, all charges were dropped.
and even if there was a crime involved, it would NOT be possession or sales of a drug because you did not possess a drug.
as far as copyrights, someone owns the celeb pics that are posted - and in making a phony, there are other laws broken involving manipulation of the image.
so better safe than sorry. canada respects international copyright laws.
anyway, jennifer aniston is SO over ;-)

I do not know when you guys are going to figure this out, but if you do not have a copyright or license to use ANY picture, celeb or not, you are in violation of too many laws to even try and list them all here, and subject to both criminal and civil prosecution. For those using a language other than English, that means you can go to prison, and you can be sued by the owner of the copyright.
Fucking A, if you guys want to make money, you should at least try to stay out of jail or courts so you can enjoy spending it.

if you package a non-narcotic and try to pass it off as drugs and sell it as such, you are still in violation of the law, at least in the US
Now, depending on the circumstances of the arrest, the prosecution may decide they do not have enough to bother spending the time or money to prosecute, but if they were bored, they could.

he told me that in fact, it WAS not legal.... but that the legislation was really too obscure, YET, and that it was taking a chance... it was ours to determine if the chance was big enough for us to take. he said that with the proper care, it should not be too dangerous... he compared it to crossing a road... you CAN be killed by a buss by crossing the road. In fact, everytime you cross a road, you take that chance. but if you're careful enough, you won't have a problem.

A couple things, first off, things change radically in a couple years, secondly, what area of law did this guy practice?
You emphasize the word WAS when you should emphasize NOT LEGAL. Not legal, means illegal, which also means criminal or civil liability.
The main thing I think your attorney failed to mention, or else you did, is the copyright issue. I mean fuck everything else, if you did not take the picture, and you did not get license to use it from the person that holds the copyright, you are at risk.
After reading the letter Jimbo received, and the subsequent post from the kid that thinks celebrities like the publicity, it is obvious that there are people out there actively hunting down the owners of websites advertising their clients name without their permission. Whether or not the site contains actual or altered phots of the celeb is irrelevant, the fact that you use their name in an effort to advertise your site subjects you to all kinds of legal actions.
Sure, you can take your chances if you want, but you are not all going to be as lucky as Jimbo to have someone willing to respond for you, and you are going to find yourself knee-deep in legal problems. If you think they will never find you, ask Jimbo if he thought he would ever be in the situation he found himself.

I think you better do some more research on my comments. I ain't the smartest man in tha world but i do have alot of common since,, When your a celeb you want to be in the public eye,, Positive or Negative(in some instances :-) someone like Paula Poundstone would prolly be out of work for awhile)
