that's the email I received today. Police visited my head reviewer and I don't want her to be in trouble. So the site is offline and the domain is for sale.

APIC has been documenting massive copyright infringement by ABSOLUTE SERIES. And the illegal posting of adult images
without proper authority, model's releases,
or proof of age. These activities by you have also been document on other websites.

This is a serious crime in Canada, and it has been going on for years.

We are prepared to prosecute all concerned. The RCMP computer crimes division in Ontario has been sent documents with
proof of your activities and is awaiting our answer before arresting all of you.

This is the only warning you will recieve from APIC.

We demand the entire site be closed today by 5 PM eastern standard time. And in its place, a notice about infringing TGP
websites and why you were closed.

If this is done to my satisfaction, I will advise the "Duty Officer" that you co-operated and no further actions are necessary at this

It does'nt seem logical for absolut to shut his site down with out the actual verification of the e-mail, but it makes me wonder cause its a poorly written e-mail in my persoanl opinion.

Please tell us if you have verified this absolut??? Though I do find it wierd that The Hun only listed 4 galleries today too.

Canada has always had much stricter laws on pornography... as far as they are concerned, they can do whatever they like...

and im not sure if they mentioned it or not... but absolut is also a trademark... though I dont know if they own the right to exclusively market it on the net. =)

I think this is a scare email by APIC.

They wouldn't make a chance in court.

TGP = linklist = search engine...

When they close down TGP's they close down linklists and when they close down linklists they close down search engines.

Only thing they can demand of you is to remove your LINK to illegal galleries. They cannot prosecute you if you have not made the gallery page.

I think, not a lawyer though...

but i see no reason: if i make galleries with unlicenced content myself and link to them from my TGP and if i link to such galleries that were made by others...

i mean we link to some galleries that have unlicenced content, and i'm sure 99% of galleries on free hosts are such ones...

does that mean that we should stop linking to free hosted galleries? Guys who use paid hosting can post a short text regarding their content licence or something...

that would be the way to go....

but then again, free hosts will die... no more smutservers and lightningfrees...

I see no reason not to list galleries from free host. If you do like EasyPic suggested on GFY (By submitting this gallery you confirm you own the pictures or have license to display them on the web bla bla) then there is really nothin more you can do except mayby ask them to fax in a copy of their license for the pictures but if you receive 1000 submissions per day it can easily be pretty complicated :D
As to submitting 9000 of your own galleries that people say Absolut did with stolen pictures is pretty much insane and I doubt that is what actually happend. Even with 10 pictures per gallery it is 90.000 pictures. I really doubt that. Perhaps there has been a total of 9000 galleries with stolen pictures but the other sounds pretty much insane to me. Especially with the size Absolut has / had he could go to basicly go to any sponsor and ask for free content he wish

For Example the most German TGP`s don`t link
to any freehosted sites with tons of crap and
ads. They only accept www.dom.de (http://www.dom.de) / .com / .net / etc. so that others
can check via internic / denic / etc. who is
the Owner of the Gallerys.

So don`t link to freehosts, dont`t take
illegal material and build your own gallerys, when you earn fat bucks like Absolut
you can buy tons of content for thousands of
gallerys (legal).

in this case, the german and european (austria, swiss, etc.) TGP`s are a little
bit better, in quality, etc. we dont cheat
the user with cj`s, blinds, etc. we don`t
have much traffic but quality traffic with
1:250 ;o)

It would be great if this case could cause the end of TGPs or at least the end of free hosts. Without free hosts majority of gallery makers will leave the business as they use stolen content and probably dont have the money to pay for content + host. Moreover, as TGP traffic sucks big time, there aint much webmasters that can make good money with it when they have to pay for content plus hosting.

a few points..fist BassChick...you can legally link illegal content in the US depending on your region..I learned this first hand with a client I host. I got called on the beast links...I called my provider..UUNET..they said it depends on Federal Law, state, and local laws....Feds said they had no restriction on the beast links....local said they base theirs on state level...Iowa's State Attorney General said that this site was legal because he didnt' actually have the content and the banners showed no human/animal contact

2nd....You guys need to slow down and read the email that absolut showed us...it plainly states that he used illegal content both his domains and freehosts....the target in the email was absolut not the entire web. However the guy who wrote the email needs to take some english comp classes because his wording is poor choice the content he is linking they mean....is copyright infringed...therefore the email sender should reword what his intentions are before sending more out to webmasters who just might post their emails like absolut did for us.

3rd You tgp owners need to stand up right now for your rights because both on absolut's site and in the email this guy is targeting all tgp's as guilty already..he pointed the finger at all of you and I'm sure some of you run clean tgps and don't build galleries with unlicensed content so fight back and put him in his place for being slanderess in a sense.

4th Quit worrying about the traffic...so some tgp's that did wrong and knew it are now going to close...more will be built and those owners after this I'm sure will be more cautious as to whom they are linking..I mean get real do you think these guys setup partner status tgp's for shits and grins..its a cover your own ass first thing..They review the content and webmaster before they ever allow partner status so why don't everybody do that and weed out the bad webmasters on the web first...All this industry needs is a good cleaning and if webmasters don't act responsibly then more and more companies lib APIC are going to do it for us

and last is...if you run copyright material illegally or you post illegal pics of underage models and content not legal in your area your playing roulette with the law...and everybody knows that in a casino when you set down to play your game the odds are in the house's favor....same applys for this...your odds are stacked and now with Baby George and Ashcroft on the war path domestic issues are going to take hard hits. another thing that can be done instead of posting where we bought content from..I mean that is promoting somebody and giving them traffic and what do they do back for you...they are just a service business and can work for their traffic to..we don't need to post that we bought it here...however everybody with legit content does get a piece of paper signed by the content company that says these domains are person are authorized to use this content .....those papers sometimes come via email..sometimes downloaded with the content and sometimes hard copied to your real mail address....but all have in common one thing..they can be scanned or placed on a webpage and a small link placed at the bottom that says This Content Licensed By: ......and then anybody including the law can see if your legal or not

APIC stated in the email to absolut that he must post the message on his site like he did. Although the controversy over wheather ABIT is lagit or not, it is best he cooperates with them. For his sake.

This is why absolut is not redirecting it to a sponsor or new site or anywhere else.

I do think however, since the traffic is his and once the galleries are gone, that there is nothing illegal about his traffic and that he should be able to do what he wishes with his traffic. Furthermore, I dont live in canada, But I would imagine they have to give you a notice first, Such as remove such and such or else. In which case he removes the galleries and he is fine. It seems odd that he was given no chance to remove the galleries and ordered to post what he did on his site. It definitly sounds controversial and I dont belive that I would of done anything without consulting with a lawyer.

As far as removing free hosts and illegal content. If it works I think it would be great, for everyone here who runs a jagit site. Signups would go through the roof and I image there would be a dramatic increase in our revenue.

Now for the current TGPs out there, I would recommend not accepting ANY free hosts (You do not benifit by accepting them, so just get rid of them) And add a checkbox to our signup page that the gallery poster must check after reading the rules (which includes that all content must be licenced)
Now lets say someone contacts you and claims to take action against you, If they do take action at least this way it shows you were taking concern and making an attempt to not allow illegal content.

I definitely wouldn't think that this case can hold any ground.. If you can close a TGP down on these grounds then you can close a SE down on these grounds.. In fact you can close down 90% of SE's down on these grounds.. And they won't, one reason, is probably because they know Altavista can pay for lawyers to run them out of money whereas most of us can't... But the same principles apply .. An SE takes 1000's of submissions a day, and the majority don't even review them, unlike TGP's .. I am not all that worried about it affecting us(knock on wood) and if worst came to worst and I had a 600 000 unique a day TGP, or whatever AS was, then I think that the Bahamas would start to look a hell of a lot more appealing then Ontario :)

Logic would have me believe that some organisation so concerned over morals and the law would have a bit more motivation to take out a site that gives public access to over 17 million sites dealing with CP alone than a TGP that lists 100-200 galleries a day where some of them may be infringing a copyright..

A copyright holder does not need to give you any notice whatsoever. The only notice they need to give is a Notice To Appear, because you're being sued. If they do give notice, it's an attempt to get you to take the stuff down, and should be regarded as an extremely generous gesture on their part. Not because of any requirement.

Yes to the first part, and I don't have any idea to the second part... I don't know what content absolut was using so I couldn;t even guess who's content it is... but given the number of pages we're talking about (9000), there's probably several... which only makes it worse. However, I'm sure Apic must have some info on who the holders are. He never would have sent the letter without something to back it up.

I don't think anyone is suing him. Looks more like he was given an opportunity to correct the problem. But that's nothing more than speculation on my part... he could very well be getting sued over it too. I don't know.

How many more webmasters are APIC going to scare and intimidate off the net they threaten cop raids and are associated with threats of 20 year prison sentences for copyright infringment. They seem to think they can challenge infringments on copyrights which belong to clients they dont represent as if there is such a thing as a civil citizens arrest or something
I realy do wish that absolut series would hire a good lawyer and challenge these bullies copyright laws have become completely vaccumus from their original intent It sounds to me like Absolut was putting traffic through his own galleries not for content but as part of a search engine plan that he forgot about I doubt that many people saw them the impact to the copyright holders in terms of damaging the value of there content was probably not that great talking single figure thousands of dollars and yet absolut has to shut down a site worth far more. Someone needs to challenge this trend in copyright prosecution and get the penalties for copyright infringment linked to the actual damage it has done to the copyright owners again.It is always difficult to pick over the remains of an umpleasant interation (as if theres any other sort) between APIC and adult webmasters though because they are so poorly written I mean not to the standard they would have to be if they actualy were planning this to be the start of some legal action.

the webmaster of absolut-series was in the wrong but site closure is too severe a punishment as in my opinion it seems to be worth more than the damage to the value of copyright he may have done(as a best guess)

yeah, i gotta say. TGP traffic is newbie traffic. Look at the guy who runs pichunter.com. he has like 200k uniques a day, and is posting to the board asking "how do i make money now? i'm making $3/day" but then says in the same breath "traffic is way more important to me than money!"

But they seem to think that he got off lightly cos he didnt get sued or that he "got what he deserved"
In my opinion he did not because I think his site is probably worth more than the actual amount to which he devalued the copyright material, its only because copyright laws have unjustly swung in favour of those with copyrights meaning payouts are higher than the infringement warrents that absolut-series had to shut down. Otherwise he could have said sue me and paid the copyright holders for the damage done and continued with his site using legit material from now on

I seriously can not believe that there are people here who are against APIC. These guys are weeding out the crappy lowlife idiots who are stealing from other legit businesses to make a quick buck.

Can you imagine someone stealing for example a cab and making money with it? He would be stealing cars AND compete with legit cab drivers who have to pay for their car insurance etc....

In this business at least 75% of all sites have STOLEN content on them! This means that all serious webmasters are competing with thieves who do not have to worry about paying for content and hosting.

I am not against TGP's but I am against gallery makers who are giving out too much for free. If everyone would have to pay for content and hosting the rules of TGP's could be less strict because their competition would not have shitloads of clean galleries to compete with them.

We should all work together and weed out those fuckers who are destroying our business.

I also do agree with you that chopping off someone’s hand for stealing an apple is not the right way to go BUT I seriously do believe that stealing content is a serious crime. It is one of the most valuable assets in this business and it should be treated as such. I think that most people do underestimate the value of content and the influence of content stealing on our business. We should all act against this practice and therefore I support APIC because they seem to be representing a lot of content providers and are actively prosecuting content stealers.

APIC didn't shut down the site they only gave AS the choice between shutting down the site and being prosecuted. AS decided that he preferred shutting down the site above a lawsuit against him.

but you say "all traffic is good traffic" and again you're right when you're talking about the part of the traffic that is able and wanting to pull their creditcard out of their wallet. what you miss is the difference between 2 types of surfers: people who are able and are open for paying for stuff and people who will never ever pay because they can't (no cc) or because they don't dare or because they won't because they don't want their wives to know or whatever! there A LOT of scumbags out there who just surf for the free porn and even if it's not there anymore as much as it used to don't pay for the shit...

what i'm trying the say is this; traffic with a high percentage of these scumbag surfers (like tgp-traffic) is bad traffic, FOR ANYTHING YOU TRY TO SELL THEM, simply because they DON'T BUY THINGS ONLINE EVER!

I have never understood why these big tgps never made their sites membership sites, either through charging something small like $10 a month, or by at least getting an email from the surfer in return for membership. I think a small fee for membership would be a great way to weed out the freeloaders and make tgps a lot more profitable. Why give it all for free??

I was working on the basis of 9000 pictures though which I thought would have been devalued by about $3000 I think this is less than absolut-series was worth.

This all bullshit. I'm from Canada and I can tell you with certainty that if you found a good lawyer in Canada they would tell you that the email from APIC is bullshit. In fact if any criminal charges would be laid it would be against APIC. In Canada its against the Criminal Code to threaten criminal charges in order force someone to do something. As if APIC has some power of the RCMP. No fucking way. The RCMP has much better things to worry about right now (like investigating terrorism in Canada) then to be concerned about the rights of pornographers. If there is any copyright infringement its a civil matter. Any threats of criminal action is just bullshit. Its about time webmasters stood up to APIC and told them to go fuck themselves.
