To all concerned
http://www.customs.ustreas.gov/121101f.htm
As you can see from the article above there was a global crackdown on a hardcore group of warez distributors...XXXHostit is in no way associated with this ring, we do not and never will deal in anything illegal, and how we got dragged into it is a mystery to us.
The US Customs just went into our datacenter and removed every single server from the network, including those of other ISP's that were using the same facilities, our name and there's weren't even on the warrant, so how they got away with it is beyond me.
Our lawyers are currently negotiating with the authorities to have our servers and those of our customers returned ASAP, and we will be pursuing hefty compensation for what in my eyes is a total disregard for an innocent party that in no way is involved with any of there claims.
We have always conducted our business in a very professional manner, and this has come as a major blow to us.
Its hard to believe that the government can ruin years of hard work, without even checking who they were taking down.
Once they realise we are the innocent party they should release our servers, and its looking like that will be with in the next 24 hours(unfortunatly gov depts don't work after hours).
We will be contacting all customers with the above message and if anyone has any comments or wants to contact us then please do so.
This is a very sad day for our company, I wouldn't wish what happened to us on our worst enemy.
I pray to god that these guys come to there senses and see what they have done, because they have done some major damage which is going to take a very long time to repair.
Regards
On behalf of the XXXHostit Team:

this is why hotlinkbanners.com is down :(
I spose it will be hard to sue the US government
I think the gov playin games with honest webmasters which are just affected by this even if they don´t deal with such stuff
all my sites are off since 12 hours and I don´t deal with warez. So that will be fair ????
SHIT
I don't know what is going on with this damn government...I am thinking this is one of its ways to impact the adult world because ALOT of adult sites was hosted here...So lets hope this situation gets resolved...The good thing about the situation is there is alot of good webmasters out there who will help the webmasters who sites are currently down...

It's hard to take on the US govt. However if this affects enough people with some deep pockets, it should get straightened out.
those fucking FBI bastards should fight against terrorism first before they kill warezgroups and kiss MS fat ass

Honestly instead of feeling sorry for the warez crews you should be angry at them because its them that caused this to happen not the US GOV.
Furthermore think of all the programmers who lost millions from these groups giving it all away. You think free porn costs us money in this biz.. Well free warez cost programmers and takes food off their tables just like free porn does to the adult industry.
I think its funny how people try to pin blame on the FEDS but computers are not toys they are communications tools. Anything contaning data or related to transmission of data is subject to FCC rules and can be seized especially with the new terrorism bills being passed.
Im sure if there is no evidence found the servers will be returned and i can tell you from past history even Verio and other big companies have had drives snatched out of their datacenter.
Maybe it will teach hosts who care more about money then law its not in their best interest and it can impact many other people. I do think its kinda shitty for somone who is innocent to suffer but there is a procedure that they follow and when agents seize property they must have some type of motive.
There was also a discussion a while back on ISPLists about this very topic and it has happend to some smaller hosters before and some without warrents.
HeLis im sure it must suck really bad for you guys right now but a word of advice work on getting back the servers with data still intact before persuing lawsuits. You dont want to piss them off and your drives happen to be mysteriously wiped clean and it can happen.
Anyway good luck!

we never had warez on our network dude our entire network was clean the problem was one of our partners was a founder of razor1911....and for that reason only our network is a business not a warez playground and we run it like that the FBI and USC have screwed us with no proof or facts
shows the US gov can do what they want when they want for any given reason good or bad :(

you make out that we were a warez haven when we werent we havnt had a warez complaint in the 2 years we have been in business
now our business has gone under cause of the FEDS!!! we have 3-4 clients who have also gone under cause of this .....all because the feds just pick people for no good reason to take there shit and even worse we werent on the damn warrant so the dick heads actually stole our machines they have no right in the world to hold them

I never said you were guilty but anything could slide thru the cracks and im sure thats exactly what the feds are looking for right now. If i were you like i said i would not piss them off to much or if you really want action go to the media and raise a stink.
People on AWI dont have any power against the feds and most dont care about anything but what you give them for free anyway.
Like i said you are not the fisrt host to go thru this situation that you say is illagal and you wont be the last.
You say you had no warez do you really track every file that every client uploads?
All i can say is cross your fingers and if your not guilty you will be fine just dont piss off the feds or they can find other shit to fuck you on.

It does not seem to me that it's their fault. They had a search warrant and all they did was seize evidence. They defiantly did not do anything against the law or anything that will put the "justice system in disrepute."

Search warrants are usually issued based on the building, not what is inside the building. They have the right on reasonable and probable grounds to seize anything that could be evidence.
If you do win and get compensated then this would set an important precedent, so, good luck!
helis... i know you never had warez on your servers... i know the whole razor thing :) and thats why i felt sorry for you guys..
i used to be partof the w society ago and there were so nice people... and i know 20-30 serious porn webmasters that run really big sites that ran warezsites before... its just that its hard to get away from it...
i understand you toker very well too... its not that i´m ignorant or stupid... i know there are guys harming programmers... I DON`T... the only ones i´d really like to harm are the MS fuckers... I DON`T GET WHY I SHOULD PAY 1 single cent to buttheads that program shit that makes my pc crash 5 times a day... i spent 100s of dollars in expensive adult software... would be very easy to crack or get them elsewhere but i bought em because the software is good and i wanted to support the work but there are guys that don´t deserve one single cent. i know some guys here surely understand that!
i´d like to hear comments about that! thx :)

Well AOL sux ass it sells the most expensive dialup service on the net think about that.. What is MS what is AOL they are name brand thats why you pay more for shit because it has a name branding.
I think its fucked up some of this shit MS gets away with i think its fucked up how their licensing works. Thats also why im still on Win98 SE im not paying for an upgrade when what i have works just fine for my needs.
The question is if you dont like it why use it free or not?
Pirated software was origially a concept designed to create more functional non restricted try and buy software. The intention was to stop companies from setting stupid limits like not being able to save files or use it 5 times and its gone ect..
As it all changed many companies stopped making trial stuff so pirates began giving out ISO and other retail stuff. This only got worse over time to the extent people oveseas and in the US began selling retail warez and cracked shit for money.
I think giving somthing out for people to try can actually benifit software companies to get their products better known. But selling it at a lower cost for your own profit is really fucked up and gives software makers no possible way to make profits off their work.
Matter fact i tried alot of free shit before i bought to be sure i get what i really want and it does what it says on the box. But if i really think its going to better my work and make my life better im sold. I can say theres nothing like buying $200-600 audio title and then finding out its total shit and the GUI sux ass.
Bottom line is software makers are feeling the losses just like you do with your bandwidth bills when no one buys shit to support your site. This is not the feds who are crying about warez groups its software makers turning up the heat just like the music industry did.
Microsoft may suck but if you dont like it dont use it its that simple and there are lots of other OS. Its not MS fault people prefer to code for windows blame them and maybe its not a bug in MS with every crash and it could be some thrid party title you installed.
Linux comes in many flavors ya know..
Personally i havent had a crash since my last format 2 weeks ago and i havent rebooted my personal network server in almost a month... Not to bad eh?
PS: There is an excellent group of hackers that call themselves the Software Piracy Association. You can get a list of registration numbers and cracks by sending an e-mail to piracy@spa.org with your home address, a list of the warez you have to trade, and the warez that you want.
Dont forget your home address!
They have even HaXoReD the UPS tracking system to allow them to send the software directly to your house, at no charge!
hehe... you won´t find anything pirated on my pc.. í´m not stupid... im not that heavy against piracy than some others but i am running seriuos buisness and its not worth risking future! i would not have posted my opinion here if i would have to lose/hide something (expect having toker against me :))

I actually know everything about this case and what happened. It's not xxxhostit direct fault, their only fault I would say they have in this is not making their contracts directly with the colo provider and backbone carrier. It does cost more but when you control your own area and carrier connection these issues will not happen.
And in regards to the facility it was a "cage" that was cleared out not the actual facility. The facility where they are at has at least 20 cages and we control 16 racks in that location now.
XXXHostit I suggest getting your own contracts, routers, cage, rebooters, switches and everything else ASAP now in the event that they do give the servers back.
Best of luck,
Phil from XXXWebhosting.com

Sorry to hear that man, all the shitty things happen to nice people :(
True, it seems that only comp rage's cage was affected by this. We're also at eXchange and haven't noticed anything.
The problem was that you colocated your servers in their particular cage so the gov had no chance to know that this is a different company and I'm afraid to say that you won't be likely to get these servers back that soon. I don't know about comp-rage's business but it appears to me that they were really heavily engaged in this warez thing. I can't imagine that the gov would otherwise seize an entire cage.
I hope you'll get back the servers but frankly I don't believe it will be anytime soon. Sorry.
