Isnt that the same guy who digged up all the old posts about hosting?

I'm not trying to defend this guy in particular, but I don't see what's wrong with him contacting you. In the real world salesmen do cold calls all the time. It's a legitimate way of generating business. Now if he sent out a blind spam message to thousands of people ok, that's spam. But you're a webmaster and a legitimate prospect, and he is selling services to webmasters. This is not spam, just a cold call. What if he really did have a better offer for you and saved you some money? Also, how is what he's doing any different from the webmaster who works his way down the UCJ site list contacting webmasters for traffic trades? Is that spam too?

Only differ is i can have my telephone number on a block list and charge the telemarketers $500 for each call. I tried opt-out in some ICQ block list and i still get shit and theres no way to stop it so its fux0red up.

That explains why you considered it spam. I can see how that would piss you off.
